Cloudflare Product Terms.

Cloudflare™ Product Terms

The following Product Terms apply if a Cloudflare Offering is included within your Quotation. In the event of a conflict between the Product Terms and the applicable Terms and Conditions, these Product Terms shall prevail, but only to the extent of such conflict. Any capitalised terms used in this document shall have the meanings set out in the applicable Terms and Conditions (save where expressly provided otherwise below) and any additional definitions outlined below shall also apply.

In these Product Terms:

Cloudflare™ Offering shall mean a Pro or Business plan provided by Cloudflare™ and re-sold by the Company.

Provider Agreement shall mean https://www.cloudflare.com/terms/

Supplemental Terms means additional terms of use pertaining to certain individual Cloudflare™ Services, if purchased by the Customer, as set forth at https://www.cloudflare.com/supplemental-terms/.

The Cloudflare™ Offering shall be provided to the Customer on the basis of the applicable Provider Agreement and any relevant Supplemental terms.

The Customer shall purchase the Minimum Spend on Cloudflare™ per month as set out on the Quotation. If the Minimum Spend is not used in any month, such spend may not be re-purposed or refunded.

The Customer will comply with the Provider Agreement, any Supplemental Terms and all applicable laws, rules and regulations applicable to its use of the Services. The relevant requirements of Cloudflare™ as set out in the Provider Agreement and the Supplemental Terms (as applicable) shall be set out mutatis mutandis in this Agreement as between the Customer and ANS. The Customer shall indemnify ANS for all and any costs, claims, losses, damages, liabilities, demands and/or expenses including legal costs incurred and/or suffered as a result of any failure by the Customer to comply therewith.

ANS is not obligated to perform any service or function using any technology that is not provided under the Cloudflare™ Offering.
